How to Get Legally Married in the U.S.

While planning the décor and style of your wedding is important, so is tying the knot legally. The requirements of a legal marriage vary from state to state, and some are downright weird. Did you know that in Connecticut, District of Columbia, Indiana, and Montana, you may be required to present a blood test and undergo a physical examination? Our guide today offers a general outline of what can be expected in most states. However, it is extremely important that you double check your state’s laws.

1. Know the General Laws of Your State

Like I mentioned earlier, all 50 states have different laws associated with marriage. Everything from minimum age requirements to who is allowed to officiate your marriage. Make sure to do your research when planning your wedding!

2. Get a Marriage License 

A marriage license is the document you need to obtain prior to getting married. Depending on where you live, you can apply for your marriage license up to 30 days before your wedding. After 30 days (in most states) your license will expire and you will need to be issued a new one. There is a small fee associated with the cost of a marriage license application, but there are some loopholes in getting out of paying for this fee. For example, in some states you can take a marriage counseling course and forego paying the licensing fees. Head on over to your county clerk’s office to get the application process started.

3. Hire a Real Officiant

Not just anyone can marry you! Civil unions (non-religious) are officiated by a judge, court clerk, or justice of the peace. Religious ceremonies are officiated by a priest, minister, or rabbi. Don’t forget to check your state’s laws on this before you hire an officiant!

4. Bring Witnesses

Along with your officiant, you must have at least 2 witnesses. The officiant and witnesses will sign the marriage license.

*helpful tip: If you’re planning to elope, your photographer, makeup artist, or even a random stranger can act as witnesses! 

5. Get a Marriage Certificate 

A marriage certificate is a copy of your license that has been certified by the government, thus making your marriage legal. Sometimes your officiant can complete this step for you, but in some states you must be present (along with your officiant) in order to present your license to the county clerk.

How to Officially Change Your Name

You definitely do not have to do this if you don’t want to, and it isn’t a stipulation of being legally married. However, we thought we’d include some information on how to officially change your name once you have your marriage certificate in hand.

  • You’ll need your marriage license (the original!)
  • Complete a Social Security card application
  • Get a new driver’s license at your local DMV
  • Change your bank accounts
  • Set up a new email signature, change your social media names, and more

*helpful tip: do this in order, because you will need your social security card to apply for a new driver’s license and so forth

Old Hollywood Glam Wedding at Ameristar Hotel and Casino

From the decor to the fashion, every inch of Erica and Mike’s wedding had a classic old Hollywood glamour to it. The couple look like they stepped out of a Grace Kelly film with Erica’s dazzling tiered Jim Hjelm gown and Mike’s bespoke tux by Joshua Kercher. Kelly Pratt Photography captured the Ameristar Hotel and Casino affair with the perfect amount of vintage charm and a whole lot of gold light.

The Inspiration:

To sum up our wedding best would be, classic with a twist of vintage/old Hollywood glam. The decor was elegant and simple, cream and blush tones with accents of orchid purple. Our fashion was very old Hollywood glam with a vintage touch. The dress had vintage charm with a romantic feel. Mike‘s tux was custom made, with our initials embroidered under the collar of his coat that had a classic cut and made him look like a movie star. We wanted to keep the wedding very true to who we are. We are two people who love to have fun, dance all night and don’t take ourselves too seriously. I think our wedding embodied exactly that.

The Moments:

Erica – I would say it was right before the reception when they were about to announce us as Mr. and Mrs. Kelch. The nervousness of ceremony was over and I had this quick moment where I realized how many people where here to celebrate us and how humbled I felt, I couldn’t wait to walk through those doors hand in hand with my new husband and start dancing the night away with all our closest friend and family.

Mike – The best moment was during the ceremony standing up there with Erica and Ben, our officiant. Ben is a friend of ours that we asked to be our officiant. It was a very personal and meaningful moment that had us laughing and crying, he did an amazing job. We couldn’t imagine it any other way and are so glad we decided to have our friend marry us!

The Couple Recommends:

Andrea, the owner of Bloom & Joy Designs and is an amazingly talented graphic designer, with a true eye for detail. She sat down with me to get a feel for what we wanted our invitations to look like and brought in small details of the wedding that really captured what the night would look and feel like. She created two designs which took weeks for us to choose from because we loved them both so much. Once we picked the design, they were done quickly. She helped us design our escort cards that sat in champagne glasses, programs, table numbers and made personalized stickers for our gift bags. She is so amazing to work with and helped tie in all of our decor for the wedding. She is truly talented.

My Friend Mike, our band, was phenomenal. The dance floor was packed the whole night and we got so many compliments on how amazing the band was. They learned a few songs for us and were so easy to work with!

Jasper of J.Noto Bakery is amazing at what he does. Our cake was fantastic and looked exactly how we imagined. We also had them make our favors which were cookies that looked like Casino chips with our name and wedding date. Jasper was so easy to work with, I’m so glad we chose them to be part of our day.

Kelly Pratt and her husband are so easy to work with and were so nice! They helped capture our day perfectly and we couldn’t have asked for better photographers! They are amazing at what they do.

The food was amazing at The Ameristar Hotel and Casino, and everyone was so great and easy to work with, especially Samantha and Jodi! These two ladies are great at what they do!
